1. Acceptance of Terms

Welcome to Kazu Navi ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Kazu Navi website, mobile application, and all related services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Kazu Navi is operated by an individual developer based in Spain. These Terms constitute a legally binding agreement between you and Kazu Navi.

2. Eligibility

To use Kazu Navi, you must be at least 16 years old (or 13 years old if you are located in the United States, with parental consent).

By using our Service, you represent and warrant that:

• You meet the minimum age requirement
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate and truthful

3. Account Registration and Security

3.1 Creating an Account

To access certain features of the Service (such as AI-powered tools and premium features), you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account

3.2 Account Responsibility

You are responsible for all activities that occur under your account. You agree not to share your account credentials or allow others to access your account. We are not liable for any loss or damage arising from your failure to protect your account information.

3.3 Account Termination

You may delete your account at any time through your Account Settings. Upon deletion, your personal data will be removed within 30 days, except where retention is required by law.

4. Description of Service

Kazu Navi provides Japanese language learning tools, including but not limited to:

• Number Converters: Convert Japanese numbers, dates, times, and counters into various formats (kanji, hiragana, romaji)
• AI-Powered Grammar Analyzer: Analyze Japanese sentence structure and grammar (Premium feature)
• Natural Translator: Translate phrases with natural nuance and formality levels (Premium feature)
• Sentence Corrector: Get corrections and improvements for Japanese sentences (Premium feature)

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

5. Free and Premium Subscriptions

5.1 Free Plan

The Free Plan includes:

• Unlimited access to all number conversion tools
• Limited free uses of AI-powered tools per month
• Access to basic features

5.2 Premium Plan

The Premium Plan is a paid subscription that provides unlimited access to all features, including unlimited use of AI-powered tools. Pricing and features are described on our Pricing Page.

5.3 Payment and Billing

• Premium subscriptions are billed monthly or annually (as selected) and automatically renew unless canceled
• All payments are processed securely through our payment provider, Creem.io
• We do not store your payment card information
• All fees are non-refundable except as required by law or as stated in our refund policy
• You are responsible for all applicable taxes

5.4 Cancellation and Refunds

You may cancel your Premium subscription at any time through your account settings or by managing your subscription via the billing portal. Upon cancellation:

• You will retain access to Premium features until the end of your current billing period
• Your subscription will not automatically renew
• No partial refunds are provided for unused time in the billing period

Refunds may be granted on a case-by-case basis at our sole discretion, particularly for billing errors or technical issues that prevented use of the Service.

5.5 Price Changes

We reserve the right to change subscription prices at any time. If we change the price of your subscription, we will provide at least 30 days' advance notice. The new price will apply to your next billing cycle after the notice period. If you do not agree to the price change, you may cancel your subscription.

6. Acceptable Use and User Conduct

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Submit false, misleading, or fraudulent information
• Use the Service to transmit harmful, offensive, or inappropriate content (including hate speech, harassment, or adult content)
• Attempt to gain unauthorized access to the Service, other accounts, or computer systems (hacking, unauthorized data scraping)
• Use automated tools (bots, scripts) to access the Service without our permission
• Abuse, overload, or disrupt the Service or interfere with other users' enjoyment (e.g., sending excessive requests to our AI APIs)
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use the Service for commercial purposes without our written consent
• Resell, redistribute, or sublicense access to the Service

We reserve the right to investigate and take appropriate action against anyone who violates these Terms, including suspending or terminating accounts and reporting to law enforcement.

7. Intellectual Property Rights

7.1 Our Content

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio, video, software, and the overall design ("Content"), are owned by Kazu Navi or our licensors and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or Content without our express written permission.

7.2 Your Content

When you use our AI-powered tools, you input Japanese text for analysis, translation, or correction ("User Content"). You retain all ownership rights to your User Content.

By using the Service, you grant us a limited, non-exclusive, worldwide license to process your User Content solely for the purpose of providing the Service (e.g., sending it to Google Gemini AI for analysis). We do not store or retain your User Content after processing.

7.3 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use and implement such feedback without any obligation or compensation to you.

8. AI-Powered Features and Accuracy

Our Service uses artificial intelligence (Google Gemini AI) to provide grammar analysis, translation, and sentence correction. You acknowledge and agree that:

• AI is not perfect: AI-generated content may contain errors, inaccuracies, or misinterpretations
• Educational tool only: Our AI features are intended as learning aids and should not be relied upon as the sole source of information for critical decisions
• No guarantees: We do not guarantee the accuracy, completeness, or usefulness of any AI-generated content
• Your responsibility: You are responsible for verifying and validating any information provided by our AI tools
• Third-party processing: Your input text is processed by Google Gemini AI, and their terms and privacy policies apply to that processing

You use AI-powered features at your own risk. We are not liable for any decisions made based on AI-generated content.

9. Third-Party Services and Links

Our Service may contain links to third-party websites, services, or resources (e.g., payment processors, analytics providers). These third parties have their own terms and privacy policies, and we are not responsible for their content, practices, or policies.

Your interactions with third-party services are solely between you and the third party. We do not endorse or assume any responsibility for third-party content or services.

10. Disclaimers and Limitations of Liability

10.1 No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Defects will be corrected
• The Service or servers are free of viruses or harmful components
• Results obtained from the Service will be accurate or reliable

10.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KAZU NAVI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall our total liability to you for all claims arising out of or related to the Service exceed the amount you paid us in the 12 months preceding the claim, or €100 (whichever is greater).

10.3 Exceptions

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such cases, our liability will be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Kazu Navi, its developer, and any affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your User Content

12. Termination

12.1 By You

You may terminate your account and stop using the Service at any time by deleting your account through the Account Settings.

12.2 By Us

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Legal or regulatory requirements

12.3 Effect of Termination

Upon termination, your right to access and use the Service will immediately cease. We will delete your personal data within 30 days, except where retention is required by law. Premium subscriptions will not be refunded upon termination for cause.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain and the European Union, without regard to conflict of law principles.

13.2 Dispute Resolution

Any disputes arising out of or related to these Terms or the Service shall be resolved through good faith negotiation. If a dispute cannot be resolved informally, it shall be submitted to the competent courts of Spain.

13.3 EU Users - Online Dispute Resolution

If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify you via email if the changes are material (if you have an account)
• Display a notice on our website

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must stop using the Service and delete your account.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kazu Navi regarding the Service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations without restriction.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, or internet service failures.
